Information for persons whose Data the Owner obtains from third-party sources

This section applies to persons whose Personal Data the Owner has not obtained from them directly, but from publicly accessible professional sources or from the providers described under "Lead generation and B2B prospecting" above. It is provided in accordance with Article 14 of the GDPR.

What Data is processed and where it comes from

The Owner may process the following categories of Personal Data relating to professionals working in organisations that may be interested in its Products: first name, last name, business email address, business telephone number, job title and position, employer and industry, professional social media profile, and content that the person has published publicly on professional social networks.

Such Data is obtained from publicly accessible professional profiles, from the websites of the organisations concerned, from the databases of the providers listed in this document, and — where the person visits this Application — from the identification service described in this document.

The Data is processed in order to present the Owner's Products to organisations that may be interested in them, to prepare and send business communications, and to produce content addressed to the recipient.

The legal basis is the legitimate interest of the Owner in promoting its business to other businesses (Article 6(1)(f) GDPR). The Owner has assessed that this interest does not override the rights and freedoms of the persons concerned, given that the Data relates to their professional activity, is limited to professional contact details and professional profile information, and is used only to make contact in a business context. Where consent is required under applicable law for a specific channel of communication, the Owner obtains it.

How long it is kept

Data relating to persons who do not become customers is kept for the time necessary to carry out the contact activity and, in any event, is deleted when the person objects or when it becomes apparent that the contact is not of interest. Data relating to the identification of visitors is kept for no longer than the retention period applied by the relevant provider.

The rights of the persons concerned

The persons concerned have the rights described in the section "The rights of Users based on the General Data Protection Regulation (GDPR)" of this privacy policy.

In particular, they have the right to object at any time to this processing, including profiling, and — where the Data is processed for direct marketing purposes — to object free of charge, without giving any reason. Following the objection the Owner shall stop the processing, remove the person from its contact lists and, where applicable, ask the provider to remove them from its database.

Objections and any other request may be sent to hello@elemento.cloud. The Owner will also inform the persons concerned of this processing at the latest when it first contacts them.

For further information, Users are requested to contact the Owner through the contact details provided in the present document.

If no other condition for Data transfer applies, Personal Data shall be transferred from the EU to third countries only if at least one of the following is met:

the transfer is necessary for the performance of a contract between the User and the Owner or of pre-contractual measures taken at the User's request; the transfer is necessary for the conclusion or performance of a contract concluded in the interest of the User between the Owner and another natural or legal person; the transfer is necessary for important reasons of public interest; the transfer is necessary for establishment, exercise or defence of legal claims; the transfer is necessary in order to protect the vital interests of the data subject or of other persons, where the data subject is physically or legally incapable of giving consent; the data transferred is sourced from a public register created under the law of the country that the data originates from; subject to further conditions, the Owner has a compelling legitimate interest to perform a one-off transfer of Personal Data.

In such cases, the Owner shall inform the User about the condition the transfer is based on via this Application.
